1. ACCEPTANCE OF TERMS
By accessing or using RestoParts (“the Platform”), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, you must not use the Platform. RestoParts is operated as part of RestoMod and provides a marketplace for buying and selling second-hand automotive parts in South Africa.
2. PLATFORM SERVICE
2.1 RestoParts operates as a marketplace platform connecting buyers and sellers of second-hand automotive parts.
2.2 The Platform operates through WhatsApp and facilitates direct communication between buyers and sellers.
2.3 RestoParts is an intermediary platform only. We do not own, sell, or take possession of any items listed on the Platform.
2.4 All transactions occur directly between buyers and sellers. RestoParts is not a party to these transactions.
3. USER REGISTRATION AND VERIFICATION
3.1 All users must complete photo ID verification through our WhatsApp system before using the Platform.
3.2 You must provide accurate, current, and complete information during registration.
3.3 You must be at least 18 years of age to use RestoParts.
3.4 You are responsible for maintaining the confidentiality of your account credentials.
3.5 You must notify RestoParts immediately of any unauthorized use of your account.
3.6 One person or entity may only maintain one account. Multiple accounts by the same user are prohibited.
4. USER CONDUCT AND PROHIBITED ACTIVITIES
4.1 Users must conduct themselves professionally and respectfully at all times.
4.2 The following activities are strictly prohibited:
- Posting false, misleading, or fraudulent listings
- Misrepresenting the condition, authenticity, or specifications of parts
- Harassment, abuse, or threatening behavior toward other users
- Using the Platform for any illegal activities
- Attempting to circumvent the Platform’s messaging system or fees
- Posting stolen goods or parts of questionable origin
- Creating multiple accounts or using fake identities
- Spamming, time-wasting, or sending excessive messages without genuine intent
- Attempting to manipulate, hack, or interfere with the Platform’s operations
- Collecting user data for unauthorized purposes
- Posting listings for items other than automotive parts
- Using automated systems or bots to interact with the Platform
4.3 Users found engaging in prohibited activities will face immediate termination without refund.
5. LISTING REQUIREMENTS
5.1 All listings must accurately describe the part being sold, including:
- Clear photographs of the actual item
- Accurate description of condition
- Accurate specifications and compatibility information
- Honest disclosure of any defects or damage
5.2 Sellers are responsible for ensuring they have the legal right to sell listed items.
5.3 Sellers must honor the price and description as listed at the time of agreement.
5.4 RestoParts reserves the right to remove any listing that violates these terms or appears suspicious.
6. PRICING AND FEES
6.1 RestoParts charges a fee for messaging services on the Platform.
6.2 All fees are non-refundable except in cases of proven Platform error.
6.3 RestoParts reserves the right to modify fees with 30 days notice to users.
6.4 Users who attempt to avoid fees through off-platform communication before completing verification and payment will be permanently banned.
7. TRANSACTIONS AND PAYMENTS
7.1 All financial transactions occur directly between buyer and seller.
7.2 RestoParts does not process, hold, or manage any payments for parts.
7.3 Buyers and sellers are responsible for arranging their own payment methods and terms.
7.4 RestoParts strongly recommends using secure payment methods and meeting in safe, public locations for exchanges.
8. LIMITATION OF LIABILITY – CRITICAL TERMS
8.1 RESTOPARTS IS NOT RESPONSIBLE FOR ANY LOSSES, DAMAGES, OR THEFT OF GOODS OR MONEY.
8.2 RestoParts provides a platform only and has no control over:
- The quality, safety, legality, or accuracy of items listed
- The truth or accuracy of listings or user communications
- The ability of sellers to deliver items
- The ability of buyers to pay for items
- The conduct of users on or off the Platform
- Shipping, courier, or delivery services used by buyers and sellers
- The packaging, handling, or transportation of items
8.3 YOU USE THE PLATFORM ENTIRELY AT YOUR OWN RISK.
8.4 RestoParts is not liable for:
- Loss of money in transactions
- Loss, theft, or damage to goods
- Non-delivery of purchased items
- Fraudulent sellers or buyers
- Defective, damaged, or misrepresented parts
- Personal injury resulting from purchased parts or meetings
- Any disputes between buyers and sellers
- Failed transactions or communications
- Data loss or account access issues
- LOSSES, DAMAGES, OR THEFT DURING SHIPPING OR DELIVERY
- Delayed, lost, or damaged shipments
- Courier or postal service failures
- Incorrect delivery addresses provided by users
- Items damaged in transit
- Parcels stolen during delivery
- Shipping costs or insurance claims
8.5 RestoParts makes no warranties regarding:
- The quality, safety, or legality of items
- The accuracy of user listings or communications
- Uninterrupted or error-free Platform operation
- The security of transactions
- Safe delivery of shipped items
8.6 TO THE MAXIMUM EXTENT PERMITTED BY LAW, RESTOPARTS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM.
8.7 SHIPPING AND DELIVERY
- All shipping and delivery arrangements are made directly between buyer and seller
- RestoParts is not involved in shipping, packaging, or delivery
- Buyers and sellers are responsible for choosing shipping methods and carriers
- Buyers and sellers are responsible for insurance on shipped items
- Claims for lost, damaged, or stolen shipments must be made with the courier/postal service, not RestoParts
- RestoParts does not refund, replace, or compensate for shipping losses
9. USER RESPONSIBILITY
9.1 Users are solely responsible for:
- Verifying the authenticity and condition of parts before purchase
- Conducting their own due diligence on sellers/buyers
- Arranging safe meeting locations
- Inspecting parts before completing transactions
- Ensuring parts are compatible with their vehicles
- Proper installation of purchased parts
- All aspects of their transactions
- All shipping and delivery arrangements
- Choosing reliable courier or postal services
- Properly packaging items for shipment
- Purchasing shipping insurance if desired
- Providing correct delivery addresses
- Tracking shipments and following up on delivery
- Filing claims with couriers for lost or damaged shipments
9.2 Users should never send money without inspecting parts in person OR using secure payment methods with buyer protection.
9.3 Users should meet in safe, public locations and take appropriate safety precautions.
9.4 SHIPPING RECOMMENDATIONS
- Always use trackable shipping methods
- Consider purchasing shipping insurance for valuable items
- Take photos of items before packaging
- Keep proof of postage and tracking numbers
- Package items securely to prevent damage in transit
- Communicate tracking information with the other party
- Use reputable courier services
10. ACCOUNT TERMINATION
10.1 RestoParts reserves the right to terminate or suspend any user account immediately, without notice or refund, for:
- Violation of these Terms and Conditions
- Fraudulent activity or misrepresentation
- Abuse of the Platform or other users
- Time-wasting behavior or spam
- Creating multiple accounts
- Any conduct deemed harmful to the Platform or its users
- Any illegal activity
10.2 TERMINATED USERS WILL RECEIVE NO REFUND OF ANY FEES PAID.
10.3 Users may not create new accounts after termination.
10.4 RestoParts may terminate accounts at its sole discretion.
11. INTELLECTUAL PROPERTY
11.1 All content on RestoParts, including logos, design, text, and graphics, is owned by RestoMod.
11.2 Users grant RestoParts a license to display their listings and communications on the Platform.
11.3 Users may not copy, reproduce, or use RestoParts’ intellectual property without permission.
12. PRIVACY AND DATA
12.1 RestoParts collects and processes user data as outlined in our Privacy Policy.
12.2 By using the Platform, you consent to data collection necessary for verification and Platform operation.
12.3 RestoParts will not sell user data to third parties.
12.4 Messages between users go directly through WhatsApp and are subject to WhatsApp’s terms and privacy policy.
12.5 POPI ACT COMPLIANCE
RestoParts complies with the Protection of Personal Information Act 4 of 2013 (POPIA).
12.5.1 Information We Collect
- Personal identification information (name, ID number from verification)
- Contact information (phone number, WhatsApp number, email address)
- Transaction history and listings
- Communication records on the Platform
- Device and usage information
12.5.2 How We Use Your Information
- To verify your identity and prevent fraud
- To facilitate transactions between buyers and sellers
- To operate and improve the Platform
- To communicate important Platform updates and notifications
- To comply with legal obligations

12.5.3 Marketing and Newsletter Consent
RestoParts may request your consent to send you:
- Marketing communications about RestoParts and RestoMod services
- Newsletters with automotive industry news and tips
- Special offers and promotions
- Updates about new features and parts listings
- Information about related RestoMod products and services
This consent is OPTIONAL and separate from your use of the Platform. You may provide consent during registration or at any time through your account settings.
You have the right to:
- Refuse marketing consent without affecting your ability to use the Platform
- Withdraw your consent at any time by clicking “unsubscribe” in any marketing email
- Request to stop receiving marketing WhatsApp messages
- Update your marketing preferences at any time

- Request deletion of your information (subject to legal retention requirements)

13. DISPUTE RESOLUTION
13.1 RestoParts is not responsible for resolving disputes between buyers and sellers.
13.2 Users must resolve transaction disputes directly with each other.
13.3 Any disputes with RestoParts shall be governed by South African law.
13.4 Users agree to attempt good-faith negotiation before pursuing legal action.
14. INDEMNIFICATION
14.1 You agree to indemnify and hold harmless RestoParts, RestoMod, and their affiliates from any claims, damages, losses, or expenses (including legal fees) arising from:
- Your use of the Platform
- Your violation of these Terms
- Your listings or transactions
- Your interactions with other users
15. MODIFICATIONS TO TERMS
15.1 RestoParts reserves the right to modify these Terms at any time.
15.2 Users will be notified of significant changes.
15.3 Continued use of the Platform after changes constitutes acceptance of new Terms.
16. NO WARRANTIES
16.1 THE PLATFORM IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND.
16.2 RestoParts makes no guarantees regarding Platform availability, accuracy, or reliability.
16.3 RestoParts does not warrant that the Platform will be secure or free from viruses or other harmful components.
17. GENERAL PROVISIONS
17.1 These Terms constitute the entire agreement between you and RestoParts.
17.2 If any provision is found invalid, the remaining provisions remain in effect.
17.3 RestoParts’ failure to enforce any right does not constitute a waiver.
17.4 These Terms are governed by the laws of South Africa.
17.5 Any legal action must be brought in South African courts.

- You understand that marketing consent is optional and can be withdrawn at any time
- You consent to the collection and processing of your personal information as outlined in these Terms
